Terms & Conditions

  1. TERMS

These Terms, along with the JETSET’s rules and regulations constitute the full and complete agreement between the parties and supersedes all prior agreements and understandings both written and oral among the parties with respect to the purchase and utilization of class packages. In the event that any provision of these Terms shall be unenforceable or invalid provision within the limits of applicable law, or be so held by applicable court decision, such un-enforceability or invalidity shall not render these Terms, the remaining clauses and provisions or portions thereof, unenforceable or invalid, and in such event, such provisions shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions. The failure of either party to enforce any provisions in these Terms shall not be construed to be a waiver of the right of such party thereafter to enforce such provision.

 

  1. MEMBERSHIP
  • 2.1 Subject to these terms and conditions, when a person has completed the online Registration he will become a Member of the Studio.
  • 2.2 Acceptance of a person as a Member is in the absolute discretion of the Company.
  • 2.3 The Company reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of any Member whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Members of the Studio. Any Member so expelled will forthwith cease to be a Member of the Studio and will not be entitled to any refund for any period during which his membership is suspended.
  • 2.4 If a Member brings a guest to the Studio for a session that guest must before the commencement of the relevant session become a Member in accordance with and subject to the Terms and Conditions.
  • 2.5 Members must be eighteen (18) or over .
  1. STUDIO OPENING TIMES
  • 3.1 Details of session times at the Studio may vary from time to time. Session times will be published by the Studio and will be available either at the Studio or at www.jetsetpilates.com
  1. PAYMENT TERMS
  • 4.1 Details of session prices and gift certificate prices are available either at www.jetsetpilates.com or directly from the Studio and will be such prices as determined by the Company from time to time
  • 4.2 A Member may not attend any session at the Studio without first booking and paying for the relevant session.
  • 4.3 Payments for sessions and gift certificates in any amount are non-refundable unless otherwise stated in the Terms and Conditions.
  1. BOOKINGS AND CANCELLATIONS
  • 5.1 Sessions are booked on a first-come first-served basis. A Member may use the waiting list function at www.jetsetpilates.com in the event that the client’s first choice session is unavailable. If a Member joins the waiting list for a particular session and then books into that session their booking will be subject to the general Terms and Conditions.
  1. USE OF FACILITIES
  • 6.1 A Member is entitled to use the Studio’s facilities provided always that the Studio may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.
  1. PERSONAL BELONGINGS
  • 7.1 Personal belongings are brought onto the Studio premises at the Member’s own risk and the Company does not accept liability for any loss or damage whatsoever to such items.
  1. DRESS
  • 8.1 Members are requested to wear a form of dress appropriate to the practice of Pilates and the Company recommends that Members wear stretch pants or shorts and a T-shirt or sports top. Members should attend sessions in non-slip socks. Footwear should be removed in the entry area.
  1. SAFETY & HYGIENE
  • 9.1 In the interests of safety and hygiene, no crockery, glass or food are permitted in the changing rooms or studio. Only water is permitted in the Studio. Other than with the exception of guide dogs no pets are permitted in the Studio buildings or grounds.
  • 9.2 Notwithstanding paragraph 11.1 above, Members must not walk around the Studio barefoot if they have verrucas or similar foot complaints.
  • 9.3 Members must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason. In the event of a fire, Members are asked to make their way to the nearest available exit.
  • 9.4 Smoking is forbidden in the Studio.
  1. GENERAL
  • 10.1 Members are required to give written notice to the Company of any change of address. Failing such notice, all communications will be assumed to have been received by the Member within five days of mailing to the last address notified to the Company.
  • 10.2 The Company reserves the right to refuse admission to the Studio.
  • 10.3 The Company may assign the benefit of the Registration Process and a Member’s membership to a third party at any time without notice to the Member.
  • 10.4 The Registration Process, including these terms and conditions, shall not be construed to grant any third-party beneficiary rights to any person.
  • 10.5 Members must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.
  • 10.7 Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Studio and which are made available to Members at the Studio will at all times remain the property of the Company and will be subject to the Company’s copyright.
  1. ACCESS TO STUDIO
  • 11.1 Subject to the purchase or receipt of a class package from JETSET Pilates LLC (“JETSET”), the purchaser or recipient of the class package (“Holder”) shall have the right to reasonably use the studio’s facilities and participate in classes at the studio strictly in accordance with these terms and conditions (“Terms”). Holder shall have no right, title, ownership, or other interests in the studio or its facilities, activities, property, premises or assets.  Holder shall follow and conform to JETSET’s rules and regulations (a copy of which are posted online at www.jetsetpilates.com), which may be updated from time to time. Failure by a studio to enforce any rule or regulation shall not be deemed or construed to be a waiver by the studio of said rules and regulations. If Holder fails to follow JETSET’s rules and regulations, the studio may, at its sole discretion, cancel Holder’s class package for breach.
  • 11.2 It is Holder’s sole responsibility, before attending any session, or participating in any activities at a studio, to notify JETSET of any circumstances affecting Holder’s health which may be exacerbated through continued use of a studio, and/or which may have arisen or worsened since Holder’s last session at a studio. JETSET reserves the right to refuse access to any Holder if, at its absolute discretion, it considers the health of the Holder may be endangered by the use of studio facilities.
  1. CLASS PACKAGES
  • 12.1 All class packages purchased or received by Holder shall be subject to these Terms, and, to the extent the Holder is also a Holder of the studio, the terms and conditions of such Holder’s Membership Agreement. Class packages are non-refundable/non-transferable, and cannot be shared with other Holders or non-Holders. Class packages can only be used in the studio location designated in such class package at the time of purchase, and do not apply to other JETSET locations. Holder is required to check-in for classes with the studio staff upon arrival. Holder may request a one-time, two (2) week complimentary pause on class packages per calendar year with thirty (30) days’ advance notice.
  • 12.2 For Holders with an unlimited class package membership, any cancellation within twelve (12) hours of a class, or failure to attend a class, will result in a fee being charged automatically to the credit card on file, with no exceptions, in alignment with the terms and fee amounts listed on www.jetsetpilates.com. For Holders on a limited class package membership, any cancellation within twelve (12) hours of a class will forfeit the class credit, and failure to attend a class will forfeit the class credit and be subject to a no show fee being charged automatically to the credit card on file, with no exceptions, in alignment with the terms and fee amounts listed on www.jetsetpilates.com. Fees are processed nightly for the day prior.
  • 12.3 Instructors and classes are subject to change, and classes may be cancelled without notice. When possible Holder will be notified of any cancellation or change via email or text. By booking a class, Holder consents to receive notifications from JETSET unless Holder has opted out. If a class is full, Holder must join the waitlist by using the waiting list function at www.jetsetpilates.com. If a spot becomes available before the twelve (12) hour window, Holder will be automatically added and notified. It’s Holder’s responsibility to remove himself or herself if Holder can no longer attend a class, to avoid penalties.
  • 12.4 Class sessions expire on the expiration date included in the class package purchase confirmation, unless otherwise stated in the promotion, offer, or online booking system. Unused classes for any month credits will not roll over to the following month.  A class package is a purchase of a limited number of classes to be taken during a specified month at a specified location, not a dollar-value credit or other transferrable credit.  The number of classes available in a package will remain the same, and no additional fee will be charged even if the price for individual classes changes during the period for which a package has been purchased.
  • 12.5 The term “Unlimited” as used in any Unlimited Membership or package (including but not limited to Single Week Unlimited, Two-Week Unlimited, Single Month Unlimited, and Monthly Unlimited Memberships) refers solely to the number of classes a member may attend within the applicable membership period, subject to the booking policies outlined below.
    • Advance Booking Limitations: Members are permitted to reserve only one (1) class per day in advance through the studio’s digital platforms (e.g., website or mobile application). This restriction applies to all future-dated reservations.
    • Same-Day Booking Allowance: Notwithstanding the above, members may attend more than one (1) class per day provided that any additional classes are reserved on the same calendar day as the scheduled class (“same-day booking”), and only if class availability permits. Same-day bookings may be made digitally via the studio’s website or mobile application. In-person booking is not required and will not be prioritized over digital booking.

 

  1. WAIVERS, CONSENTS, INDEMNIFICATION AND RELEASE
  • 13.1 HOLDER IS RESPONSIBLE TO PROTECT AGAINST THEFT OR DAMAGE TO HOLDER’S PERSONAL PROPERTY WHILE USING THE STUDIO. HOLDER WAIVES, AND RELEASES THE STUDIO FROM ANY AND ALL CLAIMS, DAMAGES, OR RESPONSIBILITY RELATING TO THE THEFT OF OR DAMAGE TO HOLDER’S PERSONAL PROPERTY AT THE STUDIO, INCLUDING WITHOUT LIMITATION, ANY BELONGINGS LEFT BY THE HOLDER IN THE LOCKER, THE LOCKER ROOM OR OTHER STUDIO FACILITIES, OR THEFT OR DAMAGE TO ANY AUTOMOBILES OR PERSONAL PROPERTY LEFT IN THE STUDIO’S PARKING LOT.
  • 13.2 HOLDER RECOGNIZES, ACKNOWLEDGES AND AGREES THAT ATHLETIC ACTIVITIES, USING THE STUDIO AND PARTICIPATING IN CLASSES OFFERED BY THE STUDIO INVOLVES AN INHERENT RISK OF PERSONAL INJURY TO HOLDER AND HOLDER’S GUESTS AND INVITEES, AND ANY AND ALL SERVICES ARE PROVIDED “AS-IS” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. BY UTILIZING THE CLASS PACKAGE AND IN USING THE STUDIO’S FACILITIES, HOLDER VOLUNTARILY AGREES TO ASSUME ALL RISKS OF PERSONAL INJURY TO HOLDER, HOLDER’S UNBORN CHILDREN, GUESTS, OR INVITEES AND WAIVES ANY AND ALL CLAIMS OR ACTIONS THAT HOLDER MAY HAVE AGAINST JETSET, ANY OF ITS PARENTS, SUBSIDIARIES, FRANCHISEES, OR OTHER AFFILIATES AND ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “JETSET PARTIES”) FOR ANY SUCH PERSONAL INJURY (AND NO SUCH PERSON OR ENTITY SHALL BE LIABLE TO HOLDER, HOLDER’S UNBORN CHILDREN, GUESTS OR INVITEES FOR ANY SUCH PERSONAL INJURY). TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, HOLDER ALSO WAIVES ALL CLAIMS AGAINST EACH JETSET PARTY, ANY OF ITS PARENTS, SUBSIDIARIES, OR OTHER AFFILIATES AND ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS HOLDER MAY HAVE UNDER ANY OF THE STATE’S CONSUMER PROTECTION STATUTES. THE PROVISIONS OF THIS PARAGRAPH SHALL SURVIVE THE EXPIRATION OR TERMINATION OF THE CLASS PACKAGE.
  • 13.3 HOLDER ACKNOWLEDGES AND UNDERSTANDS THAT AS PART OF THE FITNESS INSTRUCTION AND TRAINING SERVICES PROVIDED AT THE STUDIOS, INSTRUCTORS MAY OFFER HANDS-ON PHYSICAL ADJUSTMENTS TO ASSIST WITH PROPER ALIGNMENT, TECHNIQUE, FORM, AND/OR SAFETY. BY ENTERING INTO THESE TERMS, HOLDER CONSENTS TO SUCH PHYSICAL CONTACT. HOLDER MAY DECLINE OR WITHDRAW HIS OR HER CONSENT AT ANY TIME, VERBALLY OR IN WRITING, AND HOLDER AGREES TO COMMUNICATE ANY CONCERNS OR DISCOMFORT TO THE INSTRUCTOR IMMEDIATELY.
  • 13.4 IT IS EXPRESSLY UNDERSTOOD THAT FOR AND IN CONSIDERATION OF THE HOLDER’S RIGHT TO USE THE FACILITIES AND PARTICIPATE IN CLASSES, AND IN CONSIDERATION OF HOLDER’S RIGHT TO OBTAIN SERVICES AND TO BE LEGALLY BOUND HEREBY, THE HOLDER, FOR HIMSELF OR HERSELF AND HIS OR HER HEIRS, ANY GUEST, PERSONAL REPRESENTATIVES AND ASSIGNS, HEREBY VOLUNTARILY, KNOWINGLY, COMPLETELY AGREES TO THE FULLEST EXTENT PERMITTED BY LAW, TO INDEMNIFY, DEFEND, FOREVER RELEASE, WAIVE AND DISCHARGE THE JETSET PARTIES, FROM ANY AND ALL CLAIMS, ACTIONS, COSTS, LOSSES, EXPENSES, DEMANDS, DAMAGES OR OTHER LIABILITIES (INCLUDING ATTORNEYS’ FEES), KNOWN OR UNKNOWN, ABSOLUTE OR CONTINGENT, AND WHETHER OR NOT FIXED, WHICH THE HOLDER EVER HAD NOW HAS OR MIGHT IN THE FUTURE HAVE AGAINST ANY OF THE JETSET PARTIES, RESULTING IN ANY MANNER FROM AND/OR BY REASON OF THE HOLDER’S USE OF OR PRESENCE AT THE FACILITIES, OR BY REASON OF THE PERFORMANCE OF SERVICES REQUESTED OR ACCEPTED BY HOLDER AT THE STUDIO. THE PROVISIONS OF THIS PARAGRAPH SHALL SURVIVE THE EXPIRATION OR TERMINATION OF THE CLASS PACKAGE.
  • 13.5 HOLDER RECOGNIZES, ACKNOWLEDGES AND GRANTS PERMISSION FOR JETSET, ITS AFFILIATES, SUBSIDIARIES, FRANCHISEES, EMPLOYEES, SUCCESSORS AND/OR ANYONE ACTING WITH ITS AUTHORITY, TO TAKE AND USE STILL PHOTOGRAPHS, MOTION PICTURE, VIDEO, SOUND RECORDINGS AND/OR TESTIMONIALS OF HOLDER AND/OR ANY FAMILY HOLDER, WARD OR GUEST OF HOLDER. HOLDER HEREBY WAIVES ANY RIGHT TO INSPECT OR APPROVE THE PHOTOGRAPHS, ELECTRONIC MATTER, AND/OR FINISHED PRODUCTS THAT MAY BE USED IN CONJUNCTION WITH THEM NOW OR IN THE FUTURE. HOLDER HEREBY GRANTS ALL RIGHT, TITLE AND INTEREST HOLDER MAY NOW HAVE IN THE PHOTOGRAPHS, ELECTRONIC MATTER, AND/OR FINISHED PRODUCTS TO JETSET AND/OR ANYONE ACTING WITH ITS AUTHORITY, AND HEREBY WAIVES ANY RIGHT TO ROYALTIES OR OTHER COMPENSATION ARISING FROM OR RELATED TO THE USE OF THE PHOTOGRAPHS, ELECTRONIC MATTER, AND/OR FINISHED MATTER. HOLDER HEREBY CONSENTS TO RECEIVE RECURRING SMS COMMUNICATIONS FROM JETSET. STANDARD MESSAGE AND DATA RATES MAY APPLY. HOLDER MAY OPT OUT AT ANY TIME BY TEXTING “STOP” OR USING THE OPT-OUT LINK IN THE MESSAGES.

 

  1. GOVERNING LAW AND DISPUTES

14.1 These Terms shall be governed by and construed and enforced in accordance with the laws of the State of purchase, without giving effect to principles of conflicts of law. Any claim or dispute arising under these Terms, shall be resolved by final and binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures then in effect and will take place via written submission or remotely unless otherwise required. This section shall not preclude either party from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. NOTWITHSTANDING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY VOLUNTARILY, KNOWINGLY AND INTELLIGENTLY WAIVES ANY RIGHT TO A TRIAL IN COURT (INCLUDING BY JURY) AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION, WHETHER AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR OTHERWISE.

 

15. Membership Cancellation Rights

15.1 In addition to the terms outlined in your membership agreement, certain states provide specific rights and protections regarding membership cancellation. Please review the applicable section below for details on your state’s policies.

 

Arizona

You may cancel your purchase of JETSET classes, without penalty or obligation, at any time prior to midnight of the third business day after receiving a copy of the contract, by emailing a notice to your studio’s email address which is studioname@jetsetpilates.com (e.g. sunsetharbour@jetsetpilates.com). You will receive a full refund of your purchase. A refund shall be issued within 30 days after receipt of the notice of cancellation.

 

In the event of the relocation of your residence to farther than twenty-five (25) miles from any JETSET studio in Arizona, and upon the failure of JETSET to designate a center, with comparable facilities and services within twenty-five (25) miles of your new residence, you may cancel your purchase of JETSET classes and shall only be liable for any used classes plus expenses you have purchased. If, because of death or disability, you are unable to use or receive all services contracted for, you, or your estate, shall only be liable for any used classes allocable to the time prior to death or the onset of disability. The studio shall in such event have the right to require and verify reasonable evidence of such death or disability.

 

California 

 

5-DAY CANCELLATION RIGHT: You may choose to cancel your purchase of JETSET classes at any time prior to midnight of the fifth business day (excluding Sundays and holidays) after the date of first purchase. To cancel your purchase, you must provide a signed and dated notice to JETSET that states that you, the buyer, are canceling your purchase, or words of similar effect. The notice shall be sent via email (from an email address on file with JETSET), or delivered in person to

  • Your home studio’s email address which is studioname@jetsetpilates.com (e.g. sunsetharbour@jetsetpilates.com)
  • The address for your home studio listed here: https://jetsetpilates.com/locations/

You will receive a refund of your purchase, less the cost of services received prior to cancellation, within ten (10) days after receipt of the notice of cancellation.

 

Cancellation of Purchases Requiring Payment of $1,500 to $2,501 or more:

  • Purchases Requiring Payment of $1,500 to $2,000: If your purchase requires payment of one thousand five hundred dollars ($1,500) to two thousand dollars ($2,000) you have a right to cancel your contract at any time prior to midnight of the twentieth (20th) business day after the date of purchase, excluding Sundays and holidays.
  • Purchases Requiring Payment of $2,001 to $2,500: If your purchase requires payment of two thousand one dollars ($2,001) to two thousand five hundred dollars ($2,500), you have a right to cancel your contract at any time prior to midnight of the thirtieth (30th) business day after the date of purchase, excluding Sundays and holidays.
  • Purchases Requiring Payment of $2,501 or More: If your purchase requires payment of two thousand five hundred one dollars ($2,501) or more, you have a right to cancel your contract at any time prior to midnight of the forty-fifth (45th) business day after the date of purchase, excluding Sundays and holidays.

 

Additional Cancellation Rights: You may cancel your purchase and receive a refund if you move more than twenty-five (25) miles from a JETSET location and JETSET is unable to transfer the balance of your unused classes to a comparable facility within twenty-five (25) miles of your new residence; provided that JETSET may require written evidence of your move. You may also cancel your purchase in case of death or disability; provided that JETSET may require verification. If JETSET eliminates or substantially reduces the scope of the facilities that were available upon the date of your purchase, you may cancel the contract and receive a pro rata refund on the terms indicated above, except that JETSET reserves the right to make reasonable changes to the type or quantity of classes or equipment offered.

 

Colorado 

 

You may cancel your purchase of JETSET classes, without penalty, within three (3) business days of receiving a copy of the contract by mailing, telegramming, or delivering a written notice of cancellation to the address for your home studio listed here https://jetsetpilates.com/locations/. You will receive a full refund of your purchase, less the cost of any used classes, within fifteen (15) days after receipt of the notice of cancellation.

 

You may also cancel your purchase if you become totally physically disabled, as determined by a licensed physician or advanced practice registered nurse, for the duration of the contract.

 

Connecticut 

 

If you wish to cancel your purchase of JETSET classes, you may cancel by mailing a written notice by certified or registered mail with delivery tracking to the address for your home studio listed here https://jetsetpilates.com/locations/. The notice must say that you do not wish to be bound by your contract and must be delivered or mailed before midnight of the third business day after your first purchase.

 

You may also cancel your purchase of JETSET classes if you relocate your residence further than twenty-five (25) miles from any health club operated by the seller or from any other substantially similar health club which would accept the obligation of the seller. Your purchase may also be cancelled if you die, or if the health club ceases operation at the location where you entered into your contract or the location closest to your primary residence. If you become disabled, you shall have the option of (1) being relieved of liability for payment on that portion of the contract term for which you are disabled, or (2) extending the duration of the original contract at no cost to you for a period equal to the duration of the disability. You must prove such disability by a certificate signed by a licensed physician, licensed physician assistant, licensed advanced practice registered nurse, or other credentialed medical provider, which certificate shall be enclosed with the written notice of disability sent to JETSET.

 

If you cancel, JETSET may keep or collect an amount equal to the fair market value of the services you have already received. You will receive a refund fifteen (15) days after receipt of your notice of cancellation for the full purchase price, less the cost of any unused classes.

 

Florida 

 

You may cancel your purchase of JETSET classes, without penalty, within three (3) days of the date of first purchase, exclusive of holidays and weekends, by mailing or delivering a written notice of cancellation to the address for your home studio listed here https://jetsetpilates.com/locations/. You will receive a full refund of your purchase, less the cost of any used classes. A refund shall be issued within thirty (30) days after receipt of the notice of cancellation.

 

If any studio in Florida goes out of business or moves its facilities more than five (5) driving miles from its original location, and JETSET fails to provide, within thirty (30) days, a facility of equal quality located within five (5) driving miles of the original location, you may cancel your purchase of JETSET classes without penalty. You will receive a full refund of your purchase, less the cost of any used classes.

 

If JETSET wishes to enforce your contract after receipt of the notice, it may request the Florida Department of Agriculture and Consumer Services (the “Department”) to determine the sufficiency of the notice. If the Department determines that a refund is due to you, the refund shall be an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term.

 

You (or your estate) may cancel your purchase of JETSET classes if you die or become physically unable to avail yourself of a substantial portion of those services which you used until the time of disability. You (or your estate) may be required to provide proof of disability or death. A physical disability sufficient to warrant cancellation of the contract is established by furnishing a certification of such disability by a physician licensed under Chapter 458, 459, 460 or Chapter 461 to the extent the diagnosis or treatment of the disability is within the physician’s scope of practice. You will receive a full refund of your purchase, less the cost of any unused classes. A refund shall be issued within thirty (30) days after receipt of the notice of cancellation.

 

Should the studio go out of business, you should contact the Department within sixty (60) days. A JETSET studio shall not be deemed out of business when temporarily closed for repair and renovation of the premises:

 

  • Upon sale, for not more than fourteen (14) consecutive days; or
  • During ownership, for not more than seven (7) consecutive days and not more than two (2) periods of seven (7) consecutive days in a calendar year.

 

Georgia 

 

If you wish to cancel your purchase of JETSET classes, you have seven (7) business days from the date of first purchase to cancel. To cancel, mail or hand deliver a letter to the address for your home studio listed here https://jetsetpilates.com/locations/. To be effective, your cancellation must be postmarked, or hand delivered by midnight of the seventh business day after the date of signing of the contract and must include all contract forms and any and all other documents and evidence of membership previously delivered to you. If you cancel, any payments made or debts owed under the contract will be refunded or cancelled, less the fair market value of services actually received up to $100.

 

You may cancel your contract within thirty (30) days from the time you knew or should have known of any substantial change in the services or programs available at the time you joined. Substantial changes include, but are not limited to, changing from being coed to being exclusively for one sex or vice versa. To cancel, send a written notice of your cancellation to the address provided in your contract for sending a notice of cancellation. The best way to cancel is by keeping a photocopy and sending the cancellation by registered or certified mail, return receipt requested.

No further payments shall be due to anyone, including any purchaser of any note associated with or contained in your contract, in the event the JETSET location at which the contract is entered into ceases operation and fails to offer an alternate location, substantially similar, within ten (10) miles.

 

If you become totally and permanently disabled during your membership term, you may cancel your contract. JETSET is entitled to an amount equal to the value of the services used plus a reasonable predetermined fee. JETSET reserves the right to require and verify reasonable evidence of total and permanent disability.

 

If you should die during the membership term or any renewal term, your estate may cancel the contract. JETSET is entitled to an amount equal to the value of the services used plus a reasonable predetermined fee. JETSET reserves the right to require reasonable proof of death.

 

Illinois 

 

Your purchase of JETSET classes may be cancelled within three (3) business days after the date of first purchase (starting from the first business day after the purchase), and all monies paid, shall be refunded to you. Business day shall mean any day on which the studio is open for business. If you purchase a class or package of classes at a studio which has not yet opened for business, you shall have seven (7) calendar days in which to cancel the purchase and receive a full refund of all monies paid.

 

In the event of the relocation of your residence to farther than twenty-five (25) miles from any JETSET studio in Illinois, and upon the failure of JETSET to designate a center, with comparable facilities and services within twenty-five (25) miles of your new residence, you may cancel the your purchase of JETSET classes and shall only be liable for any used classes you have purchased, plus a reasonable fee which shall not exceed either 10% of the unused balance or $50, whichever is less.

If, because of death or disability, you are unable to use or receive all services contracted for, you, or your estate, shall only be liable for any used classes allocable to the time prior to death or the onset of disability. JETSET shall in such event have the right to require and verify reasonable evidence of such death or disability.

 

Your notice of cancellation must be in writing and delivered by certified or registered mail to the address for your home studio listed here https://jetsetpilates.com/locations/. All refunds to which you or your estate are entitled shall be made within thirty (30) days of receipt by JETSET of the cancellation notice.

 

Kentucky 

 

You may cancel your contract within three business (3) days after the date of first purchase by delivering or mailing a written notice to the address for your home studio listed here https://jetsetpilates.com/locations/. Your notice must make known that you do not wish to be bound by the contract. If the notice is delivered or mailed to the address above before midnight of the third business day after you signed your contract, you are entitled to a refund of the entire consideration paid for the contract within ten (10) days of the date on which you give notice of cancellation.

 

You may also cancel if, because of death or medical disability, you become unable to use a substantial portion of the facilities or services for thirty (30) or more consecutive days. If you wish to cancel for this reason, you must notify JETSET in writing, by certified mail, return receipt requested, or by personal delivery, to the address stated in the contract. Upon receipt of written notice from you, or from the representative of the your estate, JETSET shall pay a full refund less the cost of services actually used. You shall only receive refunds of money actually paid to JETSET by you, or on your behalf. In the case of medical disability, JETSET may require you to submit to an examination by a medical doctor agreeable to both you and JETSET. The cost of the examination shall be borne by JETSET.

 

You are also entitled to cancel if you relocate twenty-five (25) miles or more from the residence stated in the contract, and JETSET cannot provide comparable alternative facilities and services within five (5) miles of your new residence. If you wish to cancel for this reason, you must notify JETSET in writing, by certified mail, return receipt requested, or by personal delivery, to the address stated in the contract. Upon receipt of any such notice, JETSET shall pay a full refund less the cost of services actually used. You shall only receive refunds of money actually paid to JETSET by you, or on your behalf. JETSET may require written verification of the new residence, such as a lease, deed, or utility bill.

 

Maryland 

 

NOTICE OF CONSUMER RIGHTS

If your purchase has an expiration date of more than three (3) months from the date of purchase and you have made more than three (3) month’s payment in advance, you may cancel your purchase of JETSET classes within three (3) business days by notifying JETSET in writing. Written notification shall be delivered in person or by certified mail to the address for your home studio listed here https://jetsetpilates.com/locations/, return receipt requested, bearing a postmark from the United States Postal Service, and if mailed shall be postmarked by midnight of the third business day. If you cancel within three (3) business days, you will receive a full refund.

 

If your purchase has an expiration date of more than three (3) months from the date of purchase and you have made more than three (3) month’s payment in advance, and you become disabled prior to the expiration date, you are entitled to extend your JETSET classes for a period equal to the duration of the disability. This provision does not apply unless the disability is confirmed by a physician and is for a period longer than three (3) months.

 

If a JETSET facility at which you receive services is closed for a period longer than one (1) month through no fault of your own, you are entitled, at your option, to either extend the expiration of your purchase for a period equal to the period during which the facility is closed; or receive a refund equal to the amount paid by you under the contract, less the cost of any classes you have already used. If the facility is closed through no fault of JETSET, JETSET reserves the right to choose between the two remedies described above.

 

Massachusetts 

 

You may cancel your purchase of JETSET classes without any penalty or further obligation by sending a written notice of your cancellation (along with contract forms, membership cards, and any other documents or evidence of membership previously delivered to you) delivered in person or postmarked by certified or registered United States mail within three (3) business days of the date of your first purchase to the the address for your home studio listed here https://jetsetpilates.com/locations/. You will receive a refund within fifteen (15) business days of JETSET’s receipt of your notice of cancellation.

 

ADDITIONAL RIGHTS TO CANCELLATION. You or your estate may also cancel your purchase of JETSET classes for any of the following reasons: (i) if upon a doctor’s order, you cannot physically or medically partake in your purchased class(es) because of significant physical or medical disability for a period in excess of three (3) months; (ii) in case of your death; (iii) if the JETSET services to be provided are not available because the JETSET fails to open a planned location, permanently discontinues operation of a location, or substantially changes the operation of a location; (iv) if you move either your residence or your place of employment more than twenty-five (25) miles from any location operated by JETSET or a substantially similar health club which will accept the JETSET’s obligation under the contract. JETSET may require reasonable evidence of the reason for cancellation pursuant to one of the above reasons. You will receive a refund within fifteen (15) days of receipt of your notice of cancellation. Your refund will be your purchase price, provided, however, that JETSET may retain the portion of the total price representing the amount of time that the services or facilities you used prior to cancellation, and provided, further, that JETSET may demand the reasonable cost of goods and services which you have consumed or wishe to retain after cancellation of the contract. In no instance shall JETSET demand more than the full contract price from you.

 

Missouri 

 

You may cancel your purchase of JETSET classes, without penalty, by giving written notice to JETSET any time before midnight of the third business day following the date on which you signed the contract. Your written notice of cancellation must be delivered either personally or by certified mail (return receipt requested) to the address for your home studio listed here https://jetsetpilates.com/locations/. The notice of cancellation must indicate your intention not to be bound by the agreement. You will receive a full refund, less any within thirty (30) days after your notice of cancellation is received.

 

Your contract may also be cancelled if you die or become permanently disabled and unable to use a substantial portion of the services for sixty (60) or more consecutive days. If you provide notice of cancellation, you shall be refunded for the unused portion of your contract on a prorated basis. Alternatively, you may extend the term of your membership for time loss due to temporary disability. In either case, JETSET may require you to submit to a physical examination by a doctor agreeable to both JETSET and you to assess the disability.

 

New Jersey 

 

You may cancel your purchase of JETSET classes, without penalty, by giving written notice to JETSET any time before midnight of the third operating day following the date on which you received a copy of the contract. If you choose to cancel your contract, you must either: 1. personally place a telephone call to the JETSET facility where the agreement was originally entered into; 2. cancel your purchase online if you purchased a JETSET service online; 3. mail a notice of cancellation by regular, registered, or certified mail to be received within the three-day period, return receipt requested; or 4. personally deliver a notice of cancellation to the address for your home studio listed here https://jetsetpilates.com/locations/. You will receive a full refund within thirty (30) days of JETSET’s receipt of your cancellation notice. If the third operating day falls on a Sunday or holiday, notice is timely given if it is mailed or delivered as specified herein on the next operating day. Refunds will be made within thirty (30) days of receipt of the cancellation notice.

 

You may also cancel your purchase of JETSET classes for any of the following reasons by giving written notice by any method described above: (1) If you die or become permanently disabled and a physician fully describes and confirms the disability to JETSET; or (2) If you move your permanent residence more than twenty-five (25) miles from any comparable JETSET or JETSET-affiliated facility. JETSET reserves the right to require proof of the new permanent residence. If you choose to cancel your purchase for the reasons contained in this paragraph, you shall receive a refund, less a prorated share of the total contract price based upon the date the cancellation notice was received plus reimbursement for expenses incurred in an amount not to exceed 10% of the total contract price.

 

If a JETSET facility is closed for a period longer than thirty (30) days through no fault of your own, you are entitled either to extend your membership for a period equal to that of the facility being closed, or to receive a prorated refund of the amount paid under the contract.

 

If a JETSET facility that was not in existence when you made your purchase is not open for business by the date that was stated in the contract, you may cancel your purchase for a full refund of any deposit or payment made on the contract.

 

New York 

 

You may cancel your purchase of JETSET classes without any penalty or further obligation within three (3) business days from the date you receive a copy of the written contract. Your notice of cancellation must be in writing, signed by you, and mailed by either United States mail or e-mail to:

  • Your home studio’s email address which is studioname@jetsetpilates.com (e.g. sunsetharbour@jetsetpilates.com)
  • The address for your home studio listed here: https://jetsetpilates.com/locations/

Your notice of cancellation must be accompanied by the contract forms, membership cards, and/or any other documents or evidence of membership previously delivered to you. You will receive a full refund of your payment within ten (10) business days of receipt of your notice of cancellation. If you have purchased a membership which is due for renewal on a monthly basis, you shall have the right to cancel your membership within three (3) business days from the date a renewal takes effect.

 

You may also cancel your purchase of JETSET classes for any of the following reasons: (1) If upon a doctor’s order, you cannot physically receive the services because of significant physical disability for a period in excess of six (6) months; (2) If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing; (3) If you move your residence more than twenty-five (25) miles from any health club operated by seller; or (4) if the services cease to be offered as stated in the contract. If you cancel your purchase for any of the reasons stated in this paragraph, you shall be refunded an amount equal to the total contract price, less expenses incurred, the portion of the total price representing the services used or completed, and the reasonable cost of goods and services which you have consumed or wish to retain after cancellation. You shall receive this refund within ten (10) business days of JETSET’s receipt of your notice of cancellation.

 

North Carolina 

 

You may cancel your purchase of JETSET classes, without penalty or obligation, at any time prior to midnight of the third business day after the date of first purchase, by mailing or delivering a written notice of cancellation indicating your intent to not be bound by the contract to the address for your home studio listed here: https://jetsetpilates.com/locations/. You will receive a full refund of your purchase within thirty (30) days after receipt of the notice of cancellation. If the services provided for in your purchase are not yet available on the date of purchase, then your right to cancel shall be extended until midnight on the third business day after the date on which the services become available and you are notified that the services are available.

 

You may cancel your purchase of JETSET classes if you are unable to continue attending classes by reason of death or disability; or you have relocated more than eight (8) miles from your present location, and more than thirty (30) miles from the JETSET studio or any substantially similar facility that will accept JETSET’s obligation under the agreement; or JETSET relocates it’s facility more than eight (8) miles from its present location; or the services provided by JETSET are materially impaired. If you cancel your purchase for any of the reasons listed above, you are entitled to a refund in an amount that is at least 90% of the pro rata cost of any unused services, which you will receive within thirty (30) days after your request to cancel.

 

If the aggregate price of all contracts between you and JETSET exceeds one thousand five hundred dollars ($1,500), then you are entitled to cancel your purchases and receive a refund in the amount of the pro rata cost of unused services within thirty (30) days of cancellation, less a cancellation fee not to exceed the lower of 25 percent (25%) of the pro rata cost of the unused services and five hundred dollars ($500).

 

Pennsylvania 

 

You may cancel your contract, without penalty or obligation, at any time prior to midnight of the third business day after you receive a copy of the contract by mailing or delivering written notice to the address for your home studio listed here: https://jetsetpilates.com/locations/.  If the services provided for in your purchase are not yet available on the date of purchase, then your right to cancel shall be extended until midnight on the third business day after the date on which the services become available and you are notified that the services are available. You will receive a full refund of payment within forty (40) days of JETSET’s receipt of your notice of cancellation.

 

If a JETSET facility temporarily closes for thirty (30) days or less, you are entitled to receive an extension of the membership term equal to the period during which the facility is closed. If a JETSET facility closes for more than thirty (30) days and JETSET fails to provide a comparable facility within ten (10) miles of the location designated in the contract, you may cancel your purchase and receive a refund for any unused services.

 

If you relocate your permanent residence to farther than twenty-five (25) miles from any JETSET studio in Pennsylvania, and upon the failure of JETSET to designate a facility, with comparable facilities and services within twenty-five (25) miles of your new residence, you may cancel your purchase of JETSET classes and shall only be liable for any used classes you have purchased plus a predetermined fee. You (or your estate) may cancel your purchase of JETSET classes if you die or become permanently disabled. If you become temporarily disabled, you may extend your membership for a time equal to the duration of your disability.

 

South Carolina 

 

CUSTOMER’S RIGHT TO CANCEL

 

You may cancel your contract with JETSET by sending notice of your wish to cancel to JETSET before midnight of the third business day after you sign the contract to the address for your home studio listed here: https://jetsetpilates.com/locations/. ‘Business day’ means Monday through Friday excluding state holidays and federal holidays. You will receive a return of payments made and any note or other indebtedness within thirty (30) days of JETSET’s receipt of your notice of cancellation; provided, however that if you used JETESET’s facilities or services, JETSET may deduct a reasonable fee from the payments being returned based on the actual fee paid divided on a pro rata share by your number of days used.

 

In addition, you or your estate may also cancel the contract at any time by written notice to the above address if the following circumstances occur: (1) death; (2) substantial physical disability, certified by a physician, which makes it permanently impossible for you to use JETSET’s services; (3) your permanent relocation to a residence over fifty (50) miles distant from an outlet operated by JETSET, if JETSET is unable to arrange for your use of another center with equivalent major facilities and services.

 

JETSET may require presentation of information to substantiate that one of these circumstances has occurred. If the contract is cancelled because of disability, death, or permanent change of residence, JETSET shall return any note or other evidence of indebtedness and unearned prepayments.

 

If the contract is cancelled because of disability, death, or permanent change of residence, JETSET shall return any note or other evidence of indebtedness and unearned prepayments as follows: for each month that the contract was in effect, JETSET is entitled to the rate a month or a treatment which it would have charged if the contract had initially been one for the number of months or the number of treatments for which the contract was actually in effect. The rate is to be determined from a fee schedule in effect on the date of the contract.

 

Tennessee 

 

BUYER’S RIGHT TO CANCEL

 

You may cancel your contract by sending written notice of your intent to cancel to JETSET before midnight of the third day (excluding Saturdays, Sundays, and legal holidays) after you signed your contract, or, if the contract is subject to a finance charge, the seventh day after the day you signed your contract. This notice must be sent by registered mail to the address for your home studio listed here: https://jetsetpilates.com/locations/

 

Within thirty (30) days after receipt of the notice of cancellation, JETSET will return any payments made and any note executed by you in connection with the agreement.

 

In addition to any other remedies provided by law, in the event JETSET ceases operation and fails to offer you an alternate location within fifteen (15) miles, with no additional cost to you, then no further payments shall be due to anyone, including any purchaser of any note associated with or contained in your contract.

 

STATE LAW REQUIRES THAT HEALTH CLUB AGREEMENTS BE PAYABLE ONLY IN THE FOLLOWING MANNER, AND ANY HEALTH CLUB WHICH ENTERS INTO HEALTH CLUB AGREEMENTS SHALL OFFER BOTH PAYMENT OPTIONS AT THE SAME PRICE, EXCLUDING INTEREST OR FINANCE CHARGES OR OTHER EQUIVALENT CHARGES WHICH SHALL NOT EXCEED EIGHTEEN PERCENT (18%) OF THE TOTAL CONTRACT PRICE:

 

(A) FULL PAYMENT WITHIN NINETY (90) DAYS AFTER ENTERING INTO THE HEALTH CLUB AGREEMENT; OR

(B) EQUAL MONTHLY INSTALLMENTS WITH ANY DOWN PAYMENT (UNLESS EXEMPT AS PROVIDED BY LAW) LIMITED TO THIRTY PERCENT (30%) OF THE TOTAL COST OF THE AGREEMENT. PREPAYMENT IS ALLOWED AT ANY TIME WITH FULL REFUND OF UNEARNED FINANCE CHARGES.

 

PLEASE READ YOUR CONTRACT CAREFULLY. YOUR CONTRACT MAY CONTAIN PAYMENTS INCLUDING, BUT NOT LIMITED TO, ENROLLMENT FEES, ANNUAL FEES, MEMBERSHIP FEES, AND OTHER DIRECT PAYMENTS TO JETSET, INCLUDING FULL PAYMENT FOR THE MEMBERSHIP AGREEMENT OR MONTHLY INSTALLMENT PAYMENTS WITH ANY DOWN PAYMENT (UNLESS EXEMPT AS PROVIDED BY LAW) LIMITED TO THIRTY PERCENT (30%) OF THE TOTAL COST OF THE MEMBERSHIP AGREEMENT, AND, IN THE CASE OF INSTALLMENT PAYMENTS THAT ARE NOT MADE BY ELECTRONIC FUND TRANSFER OR CASH, AN ADMINISTRATIVE CHARGE, NOT TO EXCEED FIVE DOLLARS ($5.00) FOR EACH BILLING PERIOD. ALL SUCH PAYMENTS MUST BE DISCLOSED IN THE CONTRACT.

 

THERE ARE NO AUTOMATIC OR LIFETIME RENEWALS OF THE TERM INCIDENT TO THE TERM OF YOUR CONTRACT. IF JETSET PROVIDES FOR A RENEWAL OPTION, THEN, UNLESS SUCH RENEWAL TERM IS CANCELLABLE ON THIRTY (30) DAYS’ NOTICE OR LESS, SUCH OPTION MUST BE AFFIRMATIVELY AGREED TO IN WRITING BY YOU AT THE BEGINNING OF THE RENEWAL PERIOD. IF THE JETSET FACILITY IS LESS THAN OR EQUAL TO TEN THOUSAND (10,000) SQUARE FEET (GROSS) OF BUILDING SPACE, THEN THE ANNUAL COST OF SUCH RENEWAL SHALL NOT BE LESS THAN THIRTY PERCENT (30%) OF THE ANNUALIZED COST OF THE BASE MEMBERSHIP CONTRACT OR SEVENTY-FIVE DOLLARS ($75), WHICHEVER IS GREATER. HOWEVER, IF THE HEALTH CLUB FACILITY IS GREATER THAN TEN THOUSAND (10,000) SQUARE FEET (GROSS) OF BUILDING SPACE, THEN THE ANNUAL COST OF SUCH RENEWAL SHALL NOT BE LESS THAN THIRTY PERCENT (30%) OF THE ANNUALIZED COST OF THE BASE MEMBERSHIP CONTRACT OR ONE HUNDRED TWENTY-FIVE DOLLARS ($125), WHICHEVER IS GREATER. PAYMENT OF ANY RENEWAL SHALL BE MADE AS REQUIRED BY TENNESSEE CODE ANNOTATED, SECTION 47-18-305(a)(5)(B)(ii).

 

A CONTRACT OR AGREEMENT MAY HAVE A CONTINUING PROVISION OR STIPULATION THAT PROVIDES FOR A MONTH-TO-MONTH CONTINUATION OF THE INITIAL TERM OF THE AGREEMENT, PROVIDED THE BUYER HAS THE RIGHT TO CANCEL THE CONTINUING PORTION OF THE AGREEMENT AFTER FULFILLING THE ORIGINAL TERM OF THE AGREEMENT BY TENDERING THIRTY (30) DAYS’ WRITTEN NOTICE OF SUCH INTENT TO THE OPERATOR BY REGISTERED MAIL. IF SUCH CONTRACTUAL OBLIGATION HAS A CONTINUING PROVISION OR STIPULATION AFTER A REQUIRED INITIAL TERM OF MORE THAN TWO (2) MONTHS, NOTIFICATION MUST BE SENT BY JETSET TO CONFIRM THAT THE ORIGINAL OBLIGATION WAS FULFILLED AND TO REAFFIRM THE MONTH-TO-MONTH OR CONTINUING PROVISION OR STIPULATION. SUCH NOTIFICATION SHALL ALSO INCLUDE NOTICE OF THE BUYER’S RIGHT TO CANCEL THE CONTINUING MONTH-TO-MONTH OBLIGATION UPON THIRTY (30) DAYS’ WRITTEN NOTICE SENT BY YOU TO JETSET BY REGISTERED MAIL.

 

ANY RENEWAL RIGHT GRANTED UNDER YOUR CONTRACT SHALL EXPIRE ON THE FINAL DAY OF THE MEMBERSHIP AGREEMENT. HOWEVER, YOU SHALL HAVE A THIRTY (30) DAY GRACE PERIOD FROM THE DATE OF THE EXPIRATION OF THE RENEWAL RIGHT IN WHICH TO EXERCISE ANY RENEWAL RIGHT GRANTED TO YOU UNDER THE MEMBERSHIP AGREEMENT. JETSET SHALL HAVE THE RIGHT TO CHARGE A LATE PENALTY OF UP TO TWENTY-FIVE DOLLARS ($25) IF THE RENEWAL RIGHTS ARE NOT EXERCISED ON OR BEFORE THE EXPIRATION DATE AS STIPULATED IN THE MEMBERSHIP AGREEMENT OR ANY FUTURE RENEWAL PERIODS.

 

Texas 

 

You may cancel your purchase of JETSET classes and receive a full refund of the payments made under the contract by sending, not later than midnight of the third business day after the contract date, written notice of cancellation, by certified mail to the the address for your home studio listed here: https://jetsetpilates.com/locations/. You will be refunded within thirty (30) days after the date notice is received.

 

You may also cancel your purchase of JETSET classes and receive a partial refund if JETSET closes a location and fails to provide alternative facilities not more than ten (10) miles from the location of the original studio; (2) relocates the studio more than ten (10) miles from its location preceding the relocation; or (3) fails to provide advertised services. A member who dies or becomes totally and permanently disabled after the date a contract is entered into may cancel a contract and receive a refund of unearned payment.

 

Utah 

 

You may cancel your purchase of JETSET classes by emailing or mailing a written notice of your intent to cancel before midnight of the third business day after the day of first purchase. If your primary JETSET location was not fully operational and available to you at the time of your purchase, then you have until midnight of the third business day after the day on which that location became operational and available to you. You must email or mail your notice of cancellation to:

If you cancel your purchase under the rights described in this paragraph, you shall receive a full refund of all payments made, less the reasonable value of any services you have received before cancelling.

 

Virginia 

 

You may cancel your purchase of JETSET services without penalty and for a full refund by mailing or delivering written notice of your intent not to be bound by the contract. Your cancellation notice must be delivered or mailed before midnight of the third business day after you signed the contract. The notice must be delivered or mailed by certified mail, return receipt requested, to the address for your home studio listed here: https://jetsetpilates.com/locations/.

 

You may also cancel your contract if your primary JETSET facility goes out of business or relocates and fails to provide comparable alternate facilities within five (5) driving miles of your primary facility. You may also cancel if you become physically unable to use a substantial portion of the JETSET services for thirty (30) or more consecutive days, and your estate may cancel in the event of your death. You must prove you are unable to use a substantial portion of JETSET services by a doctor’s, physician assistant’s, or nurse practitioner’s certificate, and JETSET may also require that you submit to a physical examination, at JETSET’s expense, within thirty (30) days of the notice of cancellation, by a doctor, physician assistant, or nurse practitioner agreeable to you and JETSET. If you cancel after the three (3) business days, JETSET may retain or collect a portion of the contract price equal to the proportionate value of the services or use of facilities you have already received. Any refund due to you shall be paid within thirty (30) days of the effective date of cancellation.

 

Washington 

 

You may cancel your purchase of JETSET services without penalty and for a full refund by mailing or delivering written notice of your intent not to be bound by the contract to the the address for your home studio listed here: https://jetsetpilates.com/locations/. Your notice of cancellation must be mailed or delivered before midnight on the third business day after your purchase. If you cancel within the three (3) days, JETSET will return all your amounts paid under the contract, less the cost of any used classes, within thirty (30) days. JETSET may require you to return any membership card or other materials which evidence membership.

 

You (or your estate) may cancel your purchase if you die or become totally disabled. JETSET may require that the disability be confirmed by an examination of a physician. You may cancel your purchase if you move your permanent residence to a location more than twenty-five (25) miles from a JETSET studio or an affiliated studio offering the same or similar services and facilities at no additional expense to you. If at the time of your purchase, your primary residence was more than twenty-five (25) miles from a JETSET studio, then you may only cancel upon moving an additional five (5) miles or more from the studio. JETSET may require reasonable evidence of relocation. You may cancel your purchase if the JETSET studio facilities are permanently closed and comparable facilities owned and operated by JETSET are not made available within a ten (10) mile radius of the closed facility. If the contract for JETSET services was sold prior to the opening of the facility, you may cancel within the first five business days the facility opens for use and the facility begins to provide the agreed upon services.

address for your home studio listed here: https://jetsetpilates.com/locations/. Your notice of cancellation must include the confirmation email you received at the time of purchase. You will receive a full refund within thirty (30) days of receipt of your notice of cancellation, less the cost of any used classes.

You have the right to cancel your purchase during the first fifteen (15) days after the contract is made, or after the first fifteen (15) days, if, due to death, illness, injury, or a change in residence, you are unable to use the full privileges of your purchase. If you cancel, you will have to pay only for the goods or services you are entitled to up through the month in which you cancel, plus a registration fee of 5% of the price of your purchase (not counting any finance charge), not to exceed $25. You must notify the JETSET, by certified or registered mail at the address given in your contract, of your intention to cancel, or your cancellation will not be effective. If your cancellation is due to illness or injury, a certificate from a doctor of your choice must accompany your notice of cancellation to JETSET.
